There had been circulated copies of an application for the grant of a provisional premises license together with the proposed Operating Plan, Layout Plan and customer survey report. Mr Michael Wynne, Licensing Standards and Enforcement Officer advised that the premises, which consisted of a garage and shop, had changed ownership 12 months previously and the shop on site had been refurbished and the applicant wished to include the sale of alcohol.  The application was within policy and no objections had been received. Police Scotland had no comments.

The convener welcomed Mr Emslie, the applicants representative, who joined the meeting via Microsoft Teams.   Mr Emslie explained that in recent months there had been a move towards localized shopping and his client wished to offer a modest range of alcoholic goods to customers.  The applicant who owned other licensed premises within Hawick had a good track record of running successful businesses.

DECISION

GRANTED.

           Amendments to the Licence and Operating Plan to include the following:-

·          a change to the core On Sale Hours –

·           the addition to the permitted activities referred to in question 5 (Yes in column 4 – outwith core hours) of the Operating Plan, to include receptions (including weddings, funerals, birthdays, retirements etc), recorded music, dance facilities and televised sport;

·           the amendment/addition of appropriate explanation/terms at question 5(e) of the Operating Plan relating to the list of permitted activities (as to ‘Yes’ in column 4);

·           At Question 6 (b) - Children and Young Person’s access – amend wording to read – ‘Children accompanied by an appropriate adult will be allowed access when there for any sporting purpose, when dining or when attending a pre-arranged private function.

               Young Persons for the same purposes, but without the requirement of being accompanied by an adult.

               In the case of sporting clubs, it is accepted that this may not always be practical due to participation in sport, in which case the club staff, acting as responsible adult, would be required to ensure supervision of any child or young person on the premises, to ensure their safety and well-being’;

·           At Question 6 (c) – Children and Young Persons ages permitted access - amend wording to read – 0 to 15yrs Children, 16 – 17yrs Young Person;

·          At Question 6 (d) – Children and Young Persons times of access – amend wording to read – At all times when the club is open;
