Process for considering Community Asset Transfer request from Tweedgreen.

The Chairman advised that the purpose of this meeting was to set out the process for considering a Community Asset Transfer Request (CATR).  The Chief Legal Officer advised that the process being followed mirrored that set out in the report approved by Council in November 2018.  The public consultation was currently underway and this closed on 11 April.  The Chief Legal Officer further advised that the original process did not specifically reference the transfer of Common Good Fund Assets and the possible need for a second consultation period.  She was therefore drafting a report to Council to introduce a 2 stage process including a right of appeal to full Council should an application be refused.  In response to a question she confirmed that in respect of a CATR for a Common Good Fund Asset officers would provide a report to the Sub-Committee which would assist the Sub-Committee in taking their decision.  This report would include a summary of the responses to the public consultation.

DECISION

NOTED.

Before proceeding with the private business, the following motion should be approved:-

“That under Section 50A(4) of the Local Government (Scotland) Act 1973 the public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in the relevant paragraphs of Part 1 of Schedule 7A to the aforementioned Act.”

DECISION

AGREED under Section 50A(4) of the Local Government (Scotland) Act 1973 to exclude the public from the meeting during consideration of the business detailed in the Appendix to this Minute on the grounds that it involved the likely disclosure of exempt information as defined in Paragraph 6 of Part I of Schedule 7A to the Act.
