There had been circulated copies of a report by the Chief Planning and Housing Officer on Appeals to the Scottish Ministers and Local Review.

 

DECISION

NOTED that:

 

(a)       An appeal had been received in respect of Change of use of visitor parking and land to form garden ground, erection of shed and raised decking, Land West Of And Incorporating 19 Birks View Galashiels – 23/01838/FUL;

(b)       Appeal decisions had been received in respect of:

(i)        Replacement windows, Middle House, Kingsmuir Hall, Bonnington Road, Peebles – 23/00140/LBC – reporter’s decision: sustained;

(ii)       Formation of accesses and change of use of land to storage (part retrospective), Land South East of Mounthooly House, Jedburgh – 23/00657/FUL – reporter’s decision: dismissed;

(iii)      Change of use of visitor parking and land to form garden ground, erection of shed and raised decking, Land West Of And Incorporating 19 Birks View Galashiels – 23/01838/FUL – reporter’s decision: dismissed;

(iv)      There remained 1 appeal previously reported on which a decision was still awaited when the report was prepared on 15 May 2024 which related to a site at Land East of Kirkwell House, Preston Road, Duns;

(v)       Review requests had been received in respect of:

(i)        Re-orientation of 5no dwellinghouses (revision to planning permission 06/02027/FUL), erection of an additional 12 dwellinghouses and associated roads and infrastructure, Phase 2 Land At East Broomlands Riverside Drive Kelso – 22/00550/FUL;

(ii)       Erection of dwellinghouse and associated works, Site North East Of Wynnstae Cottage Main Street Kirk Yetholm – 23/01796/FUL;

(iii)      Erection of dwellinghouse with garage, Land North East Of Hawthornbank High Road Galashiels – 23/01897/FUL;

(c)       The following reviews had been determined as shown:

(i)        Replacement windows, Middle House, Kingsmuir Hall, Bonnington Road, Peebles – 23/00225/FUL – Decision of Appointed Officer Upheld (Terms of Refusal Varied);

(ii)       Change of use of derelict agricultural building and extension to form dwellinghouse and erection of 17.8m high wind turbine (tip height), The Blue House Near Swansfield Farm, Reston, Eyemouth – 23/00262/FUL – Decision of Appointed Officer Upheld;

(iii)      Erection of dwellinghouse, formation of access and associated works, Land East of Blinkbonny Farmhouse, Kelso – 23/00625/FUL – Decision of Appointed Officer Overturned subject to Conditions and a Legal Agreement;

(iv)      Replacement roof to glasshouse, Garden House Linthill, Melrose – 23/00647/FUL – Decision of Appointed Officer Upheld;

(v)       Erection of two dwellinghouses with access and associated works, Land East of Buckletons, Stichill Stables, Kelso – 23/00695/PPP – Decision of Appointed Officer Overturned subject to Conditions and a Legal Agreement;

(vi)      Commercial storage facility comprising 30 no. storage containers with associated works, Former Gas Works, Princes Street, Innerleithen – 23/01003/FUL – Decision of Appointed Officer Upheld;

(vii)    Erection of dwellinghouse, Land Adjacent Carnlea, Main Street, Heiton – 23/01065/FUL – Decision of Appointed Officer Overturned subject to Conditions and a Legal Agreement;

Private Business

Before proceeding with the private business, the following motion should be approved:

 

“That under Section 50A(4) of the Local Government (Scotland) Act 1973 the public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in the relevant paragraphs of Part 1 of Schedule 7A to the aforementioned Act.”

AGREED under Section 50A(4) of the Local Government (Scotland) Act 1973 to exclude the public from the meeting during consideration of the business detailed in the Appendix to this Minute on the grounds that it involved the likely disclosure of exempt information as defined in Paragraph 9 of Part I of Schedule 7A to the Act.
